DUI / OVI & Traffic Violations

Ohio DUI / OVI - Cleveland Traffic Violations Lawyer

If you face charges for an OVI (DUI) or traffic violations, the last thing you want to do is roll over and plead guilty. It is important to have an attorney you trust investigate the arrest and stop, so you can minimize the potential consequences. At the Warrensville Heights offices of Mark S. Frank, Attorney at Law, we will protect your rights and do everything possible to make sure you keep your license.

The police can pull you over for any traffic violation or traffic code transgression, but if they determine you are intoxicated, you could be facing more serious drunk driving charges such as OVI, formerly known as DUI. In order to keep your license in Ohio, you must consent to a breath test. While there is no time to contact a lawyer when you have been pulled over, there is plenty you can do to challenge your OVI after your arrest.

From our offices in Warrensville Heights, we will make sure the police complied with all regulations:

  • We will make sure the machines used were calibrated properly. They must be tested in a certain way before their validity can be accepted by the courts.
  • In some cases, the police did not have probable cause to pull over drivers in the first place.
  • Were the police involved trained for field sobriety tests? They must complete a certain number of training hours.

If there was an improper stop or other police violation, your case may be subject to dismissal or certain evidence obtained by the authorities may be thrown out.

Keeping Your License

If you fail to comply with the administration of a breath or blood test, your license will automatically be suspended for one year. If you are convicted of OVI, there are automatic license suspensions as well. We will work to help you retain your driving privileges, or make sure you get them back as soon as possible.

Intervention Programs for OVI Charges

While the courts will not volunteer this information on their own, there are intervention programs available for people convicted of DUI or OVI in Ohio. In lieu of going to jail, you could attend seminars or programs, such as Alcoholics Anonymous (AA), finding a way to minimize the damages and keep your license.
